South African athlete in court – level 3

Caster Semenya, a two-time Olympic gold medalist from South Africa, received a partial win in her legal battle against World Athletics.

She has differences of sexual development (DSD), which cause higher testosterone levels. Because of this, she hasn’t been allowed to run in the 800m since 2019, when new rules were introduced to limit testosterone levels for some female runners. Semenya believes these rules are unfair and discriminate against athletes like her.

The European Court of Human Rights said her right to a fair hearing was violated by the Swiss Federal Supreme Court during her 2020 appeal. However, the court didn’t decide if the rules themselves are discriminatory. Semenya’s case might now return to the Swiss courts.

Although the ruling doesn’t allow her to compete again, Semenya sees it as a step forward. She wants to protect her dignity and the rights of others with similar conditions. Many people support her and believe she was treated unfairly.

Difficult words: discriminate (to treat someone unfairly because of who they are), discriminatory (showing unfair treatment of someone because of their age, race, skin color, and so on), dignity (the feeling of being respected or valued).
