Mexico’s first indigenous top judge – level 3

Mexico has elected Hugo Aguilar as the first indigenous chief justice in over 150 years, following the country’s first judicial elections, where judges were chosen by popular vote.

Aguilar, from the Mixtec community, has expertise in agrarian law and indigenous rights. His appointment represents hope for the one in five indigenous Mexicans who have historically been underrepresented in top positions. Many see this as a historic opportunity for inclusion in the Supreme Court. However, the process has sparked criticism. Critics argue that the ruling party, Morena, politicized the judiciary by supporting candidates aligned with its interests. Aguilar has also faced scrutiny for his previous role in managing complaints from indigenous communities regarding a controversial tourist train project, where some believe he defended the project over community rights. Over the next two years, Aguilar will have to demonstrate whether he truly represents marginalized groups or primarily the establishment. His role could significantly shape the future of justice and indigenous representation in Mexico.
